Who needs a DBS/CRB Disclosure?

Disclosures are required for people working with children or vulnerable adults.

‘People working with children’ includes:-

  • A person in a position where normal duties involve contact with people under 18 years of age
  • A person living at the premises where childminding or day-care services are provided
  • Those applying to be adoptive/foster parents

‘People working with vulnerable adults’ includes:-

  • Employment or other work which is concerned with the provision of care services to vulnerable adults (a vulnerable adult is a person over 18 years of age who has a learning or physical disability, a physical or mental illness including drug or alcohol addiction or a reduction in physical or mental capacity)

There are other professions that require Disclosures, such as the security and taxi-driving industries.

These Disclosures cannot be obtained by members of the public and are only available to organisations for those professions, offices, employments, work and occupations listed in the Exceptions Order to the Rehabilitation of Offenders Act 1974.

Those working within the education sector would more than likely be entitled to apply for the Enhanced Disclosure. Please check if you meet any of the requirements listed below. Enhanced Disclosure requirements when working with children may include:

  • Unsupervised activity
  • Work for a limited range of establishments
  • Relevant personal care
  • Childminding / foster care / host families

Enhanced Disclosure requirements when working with vulnerable adults may include:

  • Healthcare
  • Personal care
  • Social work
  • Assistance with cash, bills and/or shopping
  • Assistance in the conduct of a person’s own affairs
  • Conveying to and from healthcare

Typical roles which are entitled to apply the Enhanced Disclosure would be:

Teacher/instructor, teaching assistant or guidance counsellor

Charity

Are you based in schools, care homes or hospitals? If so, you may be entitled to apply for an Enhanced or Standard DBS Check.

If you are based in domestic/commercial properties, working on behalf of a council or housing association, you may only be entitled to apply for a Basic DBS Check.

Healthcare

When working within the healthcare sector it is likely you will be entitled to an Enhanced Disclosure. To determine this, please consider if you meet any of the requirements below. Enhanced Disclosure requirements when working with children may include:

  • Unsupervised activity
  • Work for a limited range of establishments
  • Relevant personal care
  • Childminding / foster care / host families

Enhanced Disclosure requirements when working with vulnerable adults may include:

  • Healthcare
  • Personal care
  • Social work
  • Assistance with cash, bills and/or shopping
  • Assistance in the conduct of a person’s own affairs
  • Conveying to and from healthcare

Typical roles which are entitled to apply the Enhanced Disclosure would be:

Nurse, healthcare assistant or pharmacist

If you are working within a healthcare environment – such as a medical practice or dental surgery – but do not meet any of the requirements above, you may be entitled for a Standard Disclosure. An example role would be a receptionist in a dental practice.

For those in the hospitality industry it is likely that you will need to apply for a Basic Criminal Record Check.

However, if you are catering in schools or providing hospitality in a hospital where you have access to wards, you may be eligible for a Standard or Enhanced Disclosure.
